CONTEST RULES

This Contest is only open to male or female Ontario residents over the age of eighteen (18). This Contest is not open to Slimband (“Sponsor”) employees, representatives, agents, or any affiliates, advertising and promotion agencies and their immediate families and anyone living with such individuals during the Contest. In order to be eligible, entrants must enter the contest on or before November 7, 2010.

By entering this Contest, each entrant acknowledges that they have read and understood the rules and medical disclaimer (collectively known as the “Contest Rules”). Each entrant also confirms their eligibility in accordance with any and all of the rules and conditions detailed. As well, the entrant agrees to abide by the governing terms and conditions:

1. HOW TO ENTER:

To enter, fill out a ballot form and submit it at the Slimband Contest entry box located at the Slimband booth (#807) at the 2010 National Women’s Show (Toronto) at the Metro Toronto Convention Centre. The Contest opens at 12:00 pm (EST) on November 5, 2010 and to be eligible, entries must be received between the hours of 12 pm (EST) and 9 pm (EST) on November 5, 2010, 10 am (EST) and 6 pm (EST) on November 6, 2010 or 10 am (EST) and 5 pm (EST) on November 7, 2010. Ballots become property of the Sponsor. No purchase necessary. Only one entry per person. Multiple entries from the same person will void all entries from that person. No mail-ins, faxed or e-mailed entries will be accepted. By entering the contest, you acknowledge that you have read and accepted the Contest rules and the decisions of the Contest judges, which shall be final and binding upon all entrants.

2. PRIZES:

There will be one (1) prize randomly awarded on Wednesday, November 10, 2010. The prize is a Slimband adjustable gastric banding procedure valued at $16,000 (Canadian). The prize is non-transferrable and is not convertible to cash. The selected winner will be notified by telephone or email by November 10, 2010 and must correctly verify that they qualify for the procedure (as per the details outlined in the Medical Disclaimer) before being declared the winner (“Winner”). The Winner must also correctly answer a skill-testing mathematical question without any assistance whatsoever. In the event that the selected entrant does not comply with these Contest Rules, verify their medical eligibility, or cannot be contacted by November 17, 2010, his/her entry will be declared null and void and an alternative entrant will be selected from the remaining entries. In such an event, these provisions will apply to the other eligible entrant.

The Contest Sponsor reserves the right to cancel or modify the contest, as well as the right to substitute a prize of equal value. Prizes are subject to the terms and conditions of the Contest as well as the Medical Disclaimer.

The Winner must sign a waiver and release, releasing the Sponsor and its advertising and promotional agencies, the affiliates and related entities of the foregoing and all respective directors, officers, shareholders, owners, partners, employees, agents, representatives, consultants, successors and assigned from any liability in connection with this Contest or the Prizes awarded as a condition to and in advance of receiving the Prize or the Prize will be forfeited.

3. ELIGIBILITY:

The Sponsor reserves the right to verify if the Winner satisfies all Contest admissibility criteria. The Sponsor’s rulings are final and without appeal in all matters related to the promotion and awarding of the Prize. Any dispute relating to the Contest (including but without limitation to any dispute as to whether or not an entrant has complied with all of the Contest Rules) shall be resolved at the sole and absolute discretion of the Sponsor. All decisions of the Sponsor will be final and binding.

The chances of winning depend on the number of eligible entries received. All entries that are incomplete, illegible, damaged, irregular, that have been submitted through illicit means, or do not conform to or satisfy any condition of the Contest Rules, may be disqualified. The Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. All entries become the property of the Sponsor and will not be returned.

If the identity of an entrant is disputed, the authorized account holder of the phone number included at the time of the submission will be deemed to be the entrant. A selected entrant may be required to provide proof that he/she is the authorized account holder of the phone number associated with the selected entry.

4. BANNING:

The Sponsor may, in its sole discretion, prohibit any person from entering the Contest whom it believes to be abusing the rules. Abuse includes entering false information and entering more than once.

5. GENERAL:

Prior to receiving the prize, the winner will be required to show valid photo and Ontario health care ID, as well as to sign a declaration of eligibility releasing the Sponsor and its related parties from any and all liability in connection with the Contest and/or the prize. The acceptance of the prize constitutes the winner’s permission to use the entrant’s name, likeness, city and images for the purpose of advertising and publicity without any future notice or compensation, subject to applicable laws.

The Sponsor reserves the right to update any of the terms or conditions at its own discretion at any time without any advance notification. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.

MEDICAL DISCLAIMER:

The Slimband program is a two-stage process involving a laparoscopic surgical procedure and a comprehensive four-year support program all intended to encourage weight loss. The program includes post-operative and nutritional support, as well as fill adjustments, as required. These adjustments are customized to suit individual needs and therefore the actual number of required adjustments depends on the necessity of the individual. Slimband is not liable for any errors that may occur including but not limited to any misuse or inappropriate actions that in any way contradict or deviate from the post-operative and nutritional support recommendations.

In order to qualify, you must meet the medical requirements of the procedure and your body mass index must not be less than 30 or more than 55. You must also consult with your physician prior to having the procedure, and be in possession of a valid Ontario health card.
